International Arbitration in Public International Law (Track IDS)

The course International Arbitration also builds on the course ‘International Dispute Settlement’ in the first semester. It looks specifically at the public and global governance dimensions of arbitration. It addresses the role of international arbitration in settling public international law disputes. Its focus lies primarily on inter-State arbitration, and investment treaty arbitration.

The course covers the basic principles and foundation of international arbitration, and then tackles in detail the law and practice of international arbitration in international law. It includes the role of international arbitration in settling disputes in public international law and the procedure governing inter-State arbitration. Special attention will be given to the specific features of investment treaty arbitration and its public dimension.

Topics of the lectures and seminars include:

  • The role of international arbitration in settling disputes in public international law; – The procedure governing arbitration in public international law; – The Permanent Court of Arbitration; – The specific features of investment treaty arbitration – the ICSID Convention; – Selection and qualification of arbitrators, and professional ethics; – The applicable law in international arbitration; – Implementation and enforcement of arbitral awards in public international law, and the immunity of States.
