Description

Migration to and within Europe leads to a diversification of the population of the EU member states. This process is welcomed by some and contested by others. The regulation of migration and integration of migrants is a highly topical issue. In formulating a migration policy, states make a distinction between nationals and non-nationals and between different nationalities and categories of foreign nationals. This also applies to the European Union. Nowadays, migration policy in the EU is for an important part regulated by EU law. The EU treats EU nationals more favourable in regard of movement and residence rights than citizens of third countries. Within the group of third country nationals a distinction is made between for example family migrants, labour migrants and migrants seeking international protection. This course is an introduction to the way in which the EU and its member states deal with differences in shaping a migration and integration policy and the related protection against discrimination. The course has a legal perspective, but offers room for a multidisciplinary approach and is also intended for non-lawyers.

The course starts with an introduction meeting and is subsequently divided in three main themes: migration, discrimination and integration. Each theme will be explored in two interactive lectures and one session with presentations and discussion.

Course objectives

The aim of this course is to provide students with knowledge and insight in the basic concepts of migration, integration and discrimination from different perspectives. This includes basic knowledge of the relevant legal framework as well as insight in the most important dilemma’s.

After completing the course, students have acquired the following qualifications:

  • knowledge of the outlines of European migration law;

  • knowledge of the dilemmas in making a distinction based on nationality or residence status;

  • insight into the problems of the absence of a right of residence

  • insight into the application of the equal treatment principle;

  • knowledge and insight with regard to the concept of integration and the way an integration policy is shaped in different countries;

  • articulate the theme in a concise paper and presentation.

Combined interactive lectures and working groups

  • 10 meetings of 2 hours

  • Required preparation students: study the prescribed materials, write a paper twice and prepare an oral presentation once.

  • Attendance to all meetings is compulsory. The course coordinator should be informed about missing a meeting in advance.

Assessment method

Examination form(s)
The students have to write two papers of approximately 2000 words and give one oral presentation. The two papers count for 40% each of the final grade and the oral presentation for 20%.

Re-examination
Students with a final grade of 5 or lower, who have handed in the two papers and gave the oral presentation, get the possibility to write one paper of approximately 5000 words. The topic of this paper will be discussed among the student and the teacher. The grade for this paper will replace the former grade.

Exchange students have priority and will be registered for the course first. Any remaining seats will be available for students from Leiden University and other Dutch Universities.
